Endorsements to Draft Laws Authored by NA Deputies

At April 7 sitting of the NA Standing Committee on Economic Affairs, the draft law on Making Amendment and Addendum to the law on State Duty authored by Mkhitar Hayrapetyan, Vahagn Tevosyan, Anush Begloian was debated in the first reading.

Anush Begloian noted that the RA Law on Audio Visual Media, adopted last year, regulates the televisions license category, and according to the RA Law on State Duty, state duty is levied aimed at activity implementation of the subject to the license for giving licenses.

The speakers were mainly in favor of the draft law, and it was endorsed.

The package of draft laws on Making Amendments and Addenda to the RA Law on Energy and on Making Addenda to the RA Law on Energy Efficiency and Renewable Resources authored by Artashes Pertrosyan was debated in the first reading. The key rapporteur informed that the first draft law of the package was removed from the circulation as a result of debate with the Government.

The partners’ position was not negative, and he draft law was endorsed.

According to the NA deputy Nikolay Baghdasaryan, the refusal on the basis of the developers’ bids not provided by law, the provision of unfavorable baseline data and technical conditions and also the omission of deadlines set out by the Government will be excluded in case of adoption of the package of draft laws on Making Amendments and Addenda to the RA Law on Urban Development and Amending the RA Code of Administrative Offenses authored by a group of deputies of My Step faction.

The NA deputy Hripsime Grigoryan stated that there are many complaints and also there is an information that there have been no problems in administrative aspect, however it is known that they will be accumulated in terms of content this year, if the problem will not be solved. “Of course, it was desirable that the information would be in digital domain, which would stem from the urban development program document, based on which the architectural planning permission was given. If it would be in all communities, there would be no problems for entrepreneurs and developers.”

In the deputy’s opinion, though the intermediary solution is given by the initiation, there is a need of it at this moment. Hripsime Grigoryan thinks that a change must be made in ideological aspect and the architectural planning task will not be viewed as a permission. “The permission itself is viewed as an administrative act, but it is about the reference. So, it is a provision of information which cannot be refused. There can be any restriction which stems from the legislation. However, the provision of the architectural planning task to view as permission is wrong from the beginning. Even it is possible to replace the term.” In this context the deputy has been interested that in which case the permission for architectural planning can be refused and how logical is that to refuse the provision of reference.

The co-author of the initiative Nikolay Baghdasaryan has noted that the bases of the refusal are clearly defined by the Government decision. He has also underlined that there are examples when there are no objective reasons for giving a permission, consequently they shall be rejected. The deputy also stated that the reference is considered an administrative act too, consequently it is a subject to rejection.

The package of draft laws was endorsed as a result of debate.

The draft law of the Government on Making Amendments and Addenda to the RA Code on Lithosphere was debated and endorsed in the first reading.

The package of bills on Making Amendments and Addenda to the RA Law on Joint-Stock Companies authored by the NA deputies Babken Tunyan and Artak Manukyan and the enclosed package of bills were removed from the circulation by the authors’ proposal.
